Summary
NELP and allies filed an amicus brief urging the court to strike down the exclusion of live-in home healthcare workers from Washington State’s minimum wage and overtime protections.
Our brief argues that (1) the historical record of the exclusion of agricultural and domestic workers from U.S. minimum wage and overtime protections establishes a story of racial oppression; (2) no reasonable grounds exist for excluding in-home caregivers from these protections; and (3) this exclusion disparately impacts politically powerless and marginalized groups and warrants heightened scrutiny under the state’s constitution.
