DOL appeals decision of the District Court striking down it’s Association Health Plan Rule.

  • DOL appeals the Court’s decision that it exceeded its legal authority in issuing the final rule and that the bona fide association and working owner provisions of the rule is contrary to law. 
  • On April 29th DOL announced it would not take any action against any employer who relied upon the rule before the Court’s decision, implying that employers may not rely upon the rule during the pendency of its appeal.

U.S. District Court issued decision in a case challenging the Labor Department’s association health plan (AHP) rule.

  • The court concluded that DOL exceeded its legal authority in issuing the final rule and that the bonafide association and working owner provisions of the final regulation is contrary to law.
  • The assocation and working owner provisions have been set aside under the Administrative Procedures Act, and the final rule has been sent back to DOL to determine how severability provisions would affect it.

Trump DOL finalizes rule to extend sub par health plans.

  • The DOL released a final rule that encourages Americans to buy inexpensive, skimpy health plans originally designed for short-term use. The policies will be available for 12 months at a time, up from three, and can be renewed for additional years. These plans do not have to cover preexisting conditions and certain kinds of health care that the Affordable Care Act requires.
  • According to the Center for American Progress, the repeal of the individual mandate and expansion of short-term limited duration plans will result in a typical 40-year-old who purchases insurance in the marketplace paying about $970 more for health insurance in 2019 than they would have absent these actions.

The Trump Administration just rolled back protections provided under the Affordable Care Act.

  • The Labor Department issued a final regulation that radically expands access to largely unregulated health insurance through so-called Association Health Plans (AHPs).
  • This new rule undermines the ACA by allowing AHPs to cherry-pick risks to cover and benefits to offer, leaving millions of sicker individuals at risk of losing their health insurance. It exempts AHPs from the ACA consumer protections that apply to small businesses and individuals. It permits AHPs to discriminate based on age, sex, occupation and a variety of other factors.

  • Short-term plans do not need to include coverage of essential health benefits and may be denied to people with pre-existing conditions. The DOL proposes to extend their duration from 3 months to 12 months and allow them to be renewed for additional years.
