This section includes resources for federal legislative advocacy aimed at strengthening the workplace rights of particular sectors of immigrant workers, such as day laborers, and legislation and policy advocacy around issues involving the federal government, such as social security no-match letters the effects of the Hoffman Plastics decision, as well as language access to government benefits and services.
Used and Abused: The Treatment of Undocumented Victims of Labor Law Violations Since Hoffman Plastic Compounds v. NLRB Since the U.S. Supreme Court's decision in the Hoffman case, denying back pay to undocumented workers illegally discharged for engaging in union organizing, employer retaliation against undocumented workers is on the rise. This report, co-authored by NELP and the Mexican American Legal Defense and Education Fund, documents nationwide efforts by employers to convince courts that undocumented workers have no labor rights at all and their extrajudicial threats to report workers to INS. As the report shows, as a nation the U.S. must decide to enforce labor laws if it intends to have a meaningful immigration policy. (October 2003)
Summary of the Day Labor Fairness and Protection Act NELP is providing legal assistance to day labor advocates working towards the introduction of the Day Labor Fairness and Protection Act. The Act would be first the federal bill addressing the needs of day laborers. This document summarizes the provisions of the Act. (March 2003) Also available in Spanish.
